Physical existence and custody
Establish the relevant product and custody position through a transaction-specific verification route.
A description of stock is not evidence of a right to sell it.
Risk framework / Evidence, limits and exceptions
The objective is to reduce identified execution risks, not to eliminate every risk. Verification and contractual protections must work together.
01 / Separate evidence tracks
Establish the relevant product and custody position through a transaction-specific verification route.
A description of stock is not evidence of a right to sell it.
Agree independent measurement, sampling, laboratory scope and acceptance limits. Identify the actual batch and relevant dates.
A satisfactory inspection result is not a title certificate.
Confirm the issuing organisation, scope and integrity through independently obtained official contact details.
A logo, stamp, QR code or forwarded email is not self-authenticating.
Review the seller’s authority, the chain of instructions, relevant ownership or encumbrance evidence, and the contractual title-transfer mechanism.
Authority to communicate is not authority to dispose of product.
Assess applicable sanctions, origin and refining provenance, counterparties, vessel exposure where relevant, destination and customs or excise treatment.
A generic statement that product is unrestricted is not transaction-specific evidence.
02 / Controlled disclosure
For a qualified transaction, agree which information can be disclosed, by whom, at what stage and under which confidentiality arrangements.
Terminal access, direct confirmations and inspection appointments remain subject to the relevant operator’s consent and procedures. PAD.Energy does not promise unrestricted access to any terminal.
Request the relevant corporate and transaction checklist through our office. Disclosure and availability are assessed for the particular enquiry.
03 / Exception handling
An unresolved discrepancy must not be treated as an administrative detail simply because a transaction has progressed.
Identify the failed condition, inconsistent document or uncertain authority. Do not substitute a verbal reassurance for the missing evidence.
The responsible contractual party should clarify, remedy or reject the issue. Cost allocation, revised timing and any right to terminate follow the contract.
Document the evidence and authorised decision. An inspector, coordinator or terminal should not be assumed to waive another party’s contractual rights.
04 / Residual exposure
Operational interruption, banking delay, disputes, legal restrictions or an inability to perform can still affect a transaction. Appropriate contracts, insurance where relevant and professional advice remain important.
